Sitecenter.app – Terms of Service

Effective Date: 1 July 2025 (last updated 26 June 2025)

These Terms of Service ("Terms") govern your access to and use of the Sitecenter.app web application and related APIs that provide automated security-scanning, monitoring and reporting (collectively, the "Service"). The Service is operated by Sitecenter LLC, a company incorporated in Georgia ("Sitecenter", "we", "our").

By using the Service, you agree to these Terms. If acting on behalf of an organisation, you represent that you have authority to bind it.

1. Definitions

Account: User profile to access the Service.
Authorised Scan: A scan performed on infrastructure you control (see §4).
Report: The output generated by the Service.
EU Data Protection Law: GDPR and related laws.
US Privacy Law: CCPA, CPA, and similar laws.

2. Eligibility

You must be at least 18 years old and not restricted by embargo or sanctions to use this Service.

3. Account Registration

Provide accurate, up-to-date information.
Keep your credentials secure.
Update inaccurate details.
Notify us of any unauthorised access.

4. Authorisation to Scan

Verify ownership using a file, DNS, or meta tag.
You warrant you are authorised to scan.
You indemnify Sitecenter for misuse or unauthorised scans.

5. Acceptable Use

Do not scan third-party assets without permission or attempt DoS/brute-force attacks. No reverse engineering or reselling without agreement.

6. Rate Limits

Limits: 1 req/sec, 20 concurrent connections, 10,000 requests/scan. Abuse may trigger suspension.

7. Data Protection & Privacy

Controller: You; Processor: Sitecenter.
Data retention: 30 days (raw), 365 days (reports).
EU transfers use Standard Contractual Clauses.
No selling or sharing personal info under US law.

You assign all IP rights to feedback you submit.

10. Warranties

Service is provided \"as-is\". No guarantee of complete security or vulnerability coverage.

11. Liability

Max liability: EUR 100 or the last 12 months' fees. No liability for indirect losses unless required by law.

12. Indemnification

You indemnify Sitecenter for unlawful or unauthorised use.

13. Suspension & Termination

We may suspend accounts for violations. You can cancel anytime; data will be deleted within 30 days.

14. Terms Changes

We will notify you 15 days in advance before any change. Continued use implies acceptance.

15. Governing Law

Law: Georgia. Disputes settled under GIAC arbitration rules, in English. EU consumers may use home courts.

16. Sanctions & Export

You confirm compliance with sanctions and export laws.

17. Severability

If one provision is invalid, others remain effective. No waiver without written agreement.

18. Entire Agreement

These Terms, plus the DPA, form the full agreement.
